Beyond A Reasonable Doubt: What is it?

Considered to be one of the highest standards of proof in criminal law, “beyond a reasonable doubt” is often phrased in movies and television dramas featuring a criminal trial, such as the 2009 thriller featuring Michael Douglas under the same name. Its recognition relies on the fact that it ensures that individuals are not convicted unless their guilt has been proven beyond any reasonable question, leaving no doubts about the defendant’s guilt.

On the other hand, the general principle, beyond reasonable doubt is vital to the criminal justice system as it upholds the fundamental principle of presumption of innocence — where every defendant is innocent until proven guilty. Therefore, it is not mere speculation. Unlike civil cases, the prosecution has the burden of proof in criminal cases, being the ones responsible for presenting evidence and testimony to the judge or jury to establish guilt.

On the other hand, the defense focuses on introducing doubt into the minds of the jurors, instead of finding ways to prove the defendant’s innocence, by presenting evidence that directly contradicts the prosecution’s claims. Making jurors question the validity of the charges and its elements beyond a reasonable doubt is the goal, and it can be achieved through:

  • Challenging the credibility of the witnesses and highlighting inconsistencies in their testimonies;
  • Presenting alternative explanations for the evidence while also challenging credibility;
  • Using expert witnesses to their advantage;
  • Highlighting inconsistencies in the prosecution’s case.

As a defendant facing a criminal charge, it is essential to explore all options for defense and not overlook the power of a strategic defense team. When our firm, Tacopina Seigel & DeOreo, decide to take a case, our strong commitment to the client lays the groundwork. If you’re facing criminal charges, you are unlikely to have a friend in the prosecutor’s office — you’ll need the help of an experienced defense attorney like Joseph Tacopina.
